Terms and Conditions of Participation in the Event

Terms and Conditions of Participation in the Event „HWBAS Groundbreaking Ceremony 2026" organized by HWBAS Sp. z o.o. with its registered office in Warsaw (ul. Wspólna 47/49, 00-680 Warsaw), NIP: 7011247972, KRS: 0001158137, hereinafter referred to as the „Organizer", on the premises of the plant located in Gorzów Wielkopolski, on 4 November 2026.

CHAPTER I — General provisions and rules of admission

§ 1 – Definitions

1. Terms used in the Terms and Conditions mean:

  • Organizer – HWBAS Sp. z o.o., organizing the Event;
  • Event – a closed special event including an official part, a possible tour of the plant, and an evening reception under the name „HWBAS Groundbreaking Ceremony 2026";
  • Participant – an adult invited by the Organizer to participate in the Event, in particular a customer, contractor, guest, employee of partner companies, or an accompanying person admitted by the Organizer to participate in the Event;
  • Main Invitee – a Participant for whom a personal invitation has been issued, including a Participant registering an accompanying person;
  • Accompanying Person – an adult participating in the Event on the basis of a registration or invitation linked to the Main Invitee;
  • Event Area – exclusively those parts of the Organizer's property that have been designated for the participation of Participants, i.e. in particular: the welcome area, the official part area, the banquet area, designated communication routes, guest restrooms, designated smoking area, guest parking and, if the Organizer so decides, the designated plant tour route;
  • Excluded Zones – all parts of the plant not made available to Participants, in particular technical rooms, production facilities outside the tour route, employee locker rooms, warehouses, offices, server rooms, switchgears, employee social rooms, technological roads, and other areas marked as inaccessible.

§ 2 – Nature and Program of the Event

1. The Event is closed and takes place exclusively for persons invited by the Organizer.

2. Only adults may participate in the Event.

3. The Event takes place on the premises of the Organizer's workplace, therefore each Participant is obliged to exercise extreme caution, follow the instructions of the Organizer, security, technical staff, and order services, as well as to respect the safety rules applicable on the plant premises.

4. The Organizer reserves the right to change the program of the Event, including the start and end times of individual parts, the order of program points, the arrangement of zones, admission rules, rules of moving around the Event Area, and the number and composition of tour groups, if this is justified by organizational, technical, safety, trade secret protection, or other circumstances beyond the Organizer's control.

5. The changes referred to above do not constitute a basis for any claims against the Organizer, except for claims arising from mandatory provisions of law.

§ 3 – Registration for the Event and acceptance of the Terms and Conditions

1. The Terms and Conditions are made available to Participants before the Event and at the entrance to the Event Area.

2. Entering the Event Area, in particular crossing the gate, barrier, or entry control point, means confirming familiarization with the Terms and Conditions and an obligation to comply with them.

3. At the stage of registration for the Event, the Participant submits, via the registration form, statements corresponding to the structure of checkboxes provided by the Organizer, including in particular:

  • a statement of having read and accepted the Terms and Conditions;
  • confirmation of familiarization with the information on the processing of personal data in connection with registration and participation in the Event;
  • other organizational statements required to participate in the Event or a specific part thereof, in particular regarding participation in the plant tour and safety rules;
  • separate consents, if the Organizer provides for collecting them for specific purposes, in particular consent to the free-of-charge recording and dissemination of the Participant's individual image.

4. The statements and consents referred to in sec. 3 produce effects in accordance with their content, purpose, and legal basis indicated by the Organizer next to the registration form and in the information clause. Failure to grant optional consent cannot cause negative consequences for the Participant's participation in the Event, unless a given consent is objectively necessary to perform the service to which it relates.

5. Acceptance of the Terms and Conditions and submission of mandatory statements required for registration do not replace optional consents collected separately for individual purposes, and such consents may be withdrawn on the terms indicated by the Organizer.

6. Invitations and registration confirmations are personal and, as a rule, are not transferable to another person without the prior consent of the Organizer.

7. In the event of resignation from participation in the Event, the Main Invitee should immediately inform the Organizer thereof.

8. The Organizer may allow the participation of a person substituting the Main Invitee or an Accompanying Person, provided that such person is registered in advance and their participation is confirmed by the Organizer.

§ 4 – Verification of guests and admission rules

1. Only persons on the guest list or holding a valid invitation (QR code ticket) or another form of authorization indicated by the Organizer are admitted to the Event Area.

2. The Organizer, security, or persons acting on its behalf have the right to:

  • verify the Participant's identity;
  • request the presentation of an identity document;
  • refuse admission to the Event Area to a person whose data cannot be confirmed or who does not meet the admission conditions.

3. In case of doubt as to the Participant's age, the Organizer or staff have the right to request the presentation of a document confirming adulthood.

§ 5 – Refusal of admission and removal from the Event Area

1. The Organizer, security, or authorized persons have the right to refuse admission or order a person to leave the Event Area who:

  • is under the visible influence of alcohol or intoxicants;
  • behaves aggressively, provocatively, or in a manner threatening safety, order, or the good name of the Organizer;
  • violates the Terms and Conditions, safety rules, or instructions issued by the Organizer, guide, security, or staff;
  • attempts to enter Excluded Zones;
  • refuses to undergo justified identity verification.

2. A person who is refused admission or removed from the Event Area for the reasons indicated in sec. 1 is not entitled to any claims against the Organizer on this account, except for claims arising from mandatory provisions of law.

§ 6 – Responsibility for accompanying persons

1. The Main Invitee is obliged to ensure that the Accompanying Person introduced by them reads and complies with the Terms and Conditions.

2. The Main Invitee is liable to the Organizer for damages caused by the Accompanying Person registered by them under the principles specified in legal regulations and on the principle of the obligation to repair the damage to the Organizer.

3. The provision of sec. 2 does not exclude the liability of the Accompanying Person themselves for the damage caused.

CHAPTER II — Plant / production hall tour

§ 7 – Rules for organizing the tour

1. If the Organizer provides for a tour of the plant or its part, only Participants who declared such participation at the registration stage and confirmed familiarization with the safety rules, rules of moving around the plant, and health and safety instructions applicable during the tour may participate in the tour.

2. The tour takes place exclusively in organized groups, under the supervision of a guide or employee designated by the Organizer.

3. The Participant may take part in the tour only to the extent and time indicated by the Organizer.

§ 8 – Obligation to comply with instructions

1. During the tour, the Participant is strictly obliged to follow the instructions of the guide, security, technical staff, and other persons designated by the Organizer.

2. The Organizer may refuse admission to the tour or exclude a Participant from the tour who violates safety rules or fails to follow instructions.

§ 9 – Sobriety during the tour

1. Only sober persons may participate in the tour.

2. The Organizer, guide, security, or staff have the right to refuse admission to the tour to a person whose behavior indicates that they have consumed alcohol or are under the influence of intoxicants.

§ 10 – Prohibition of unauthorized movement

1. During the tour, it is forbidden to:

  • separate from the group;
  • move unauthorized outside the designated route;
  • enter Excluded Zones;
  • touch machines, devices, control panels, installations, production materials, or elements of technical infrastructure.

2. The Participant is obliged to exercise extreme caution and move only along the route designated by the Organizer.

§ 11 – Organizational changes

1. The Organizer reserves the right to:

  • change the tour route;
  • shorten the tour time;
  • cancel the tour in whole or in part, if it is justified by technical, organizational, safety, or trade secret protection reasons.

2. Changing or canceling the tour does not constitute a basis for any claims against the Organizer.

CHAPTER III — Security, rules of movement and prohibited items

§ 12 – Accessible and excluded zones

1. Participants may stay exclusively in zones made available by the Organizer.

2. Entry into Excluded Zones is strictly prohibited.

3. The Participant is obliged to use exclusively designated communication routes.

§ 13 – Prohibited items and activities

1. It is forbidden to bring, possess, or use on the Event Area:

  • weapons, ammunition, and other dangerous items;
  • explosive, pyrotechnic, and flammable materials;
  • sharp tools, the possession of which is not justified by the nature of the Event;
  • intoxicants or psychotropic substances;
  • drones and other unmanned aerial vehicles;
  • animals, with the exception of assistance dogs, if legal regulations grant such a right.

2. The Organizer or security may refuse admission to the Event Area to a person possessing the items referred to in sec. 1, or order their immediate removal from the Event Area.

§ 14 – Fire, smoking, and stimulants

1. A total ban on the use of open fire applies within the Event Area.

2. Smoking tobacco and using e-cigarettes is allowed exclusively in places clearly indicated by the Organizer, subject to safety standards set by the Organizer (incl. regarding the disposal of cigarette butts).

3. Cigarette butts and other smoking-related waste must be disposed of exclusively in designated containers or ashtrays.

§ 15 – Technical infrastructure and conditions on the plant premises

1. It is forbidden for Participants to use power sockets, switchgears, technical devices, and plant infrastructure without the Organizer's prior consent.

2. The Participant acknowledges that specific technical or environmental conditions may occur on the plant premises, including increased noise, varying temperature, intense lighting, lighting effects, including stroboscopic or laser light.

3. Persons sensitive to intense light or sound stimuli should exercise special caution.

§ 16 – Restrooms and social infrastructure

1. Participants are obliged to use exclusively the restrooms and rooms indicated by the Organizer.

2. It is forbidden to use employee locker rooms, employee social facilities, and other rooms not intended for guests.

CHAPTER IV — Catering and open bar

§ 17 – Rules for using catering and open bar

1. During the Event, the Organizer may provide Participants with catering and an open bar in designated zones.

2. Alcohol may be served exclusively to adults and sober persons.

3. Bartending staff, the Organizer, security, or authorized persons have the right to refuse serving alcohol to a person:

  • whose behavior indicates a state of intoxication;
  • behaving aggressively, inappropriately, or posing a threat;
  • violating the Terms and Conditions or staff instructions.

4. The decision to refuse serving alcohol is final and does not require justification.

§ 18 – Responsibility for alcohol consumption

1. Each Participant consumes alcohol at their own risk, in moderation, and with regard to safety rules.

2. The Organizer is not liable for the consequences of alcohol consumption by the Participant, including personal injury or property damage resulting from the behavior of a Participant under the influence of alcohol, unless the damage was caused by the fault of the Organizer or persons for whom the Organizer is responsible.

§ 19 – Allergens and restrictions on moving beverages

1. Information about allergens or basic ingredients of the dishes served is available from the catering staff or in a place indicated by the Organizer.

2. It is forbidden to take alcohol, beverages in glass containers, and glass tableware outside the designated banquet area, in particular to the tour route, communication routes, parking lot, and technical zones.

CHAPTER V — Crisis management, medical assistance, and evacuation

§ 20 – Emergency procedures and evacuation

1. In the event of an alarm being announced, alarm signals being triggered, an evacuation order, or the occurrence of another threat, each Participant is obliged to:

  • immediately cease participation in the Event;
  • follow the instructions of the Organizer, security, emergency services, and voice announcements;
  • go to the designated assembly point: evacuation assembly point (in front of the internal building).

2. It is forbidden to ignore alarm signals and take actions that hinder evacuation.

§ 21 – Medical security

1. During the Event, the Organizer provides medical security, including the presence of a hired ambulance or medical team at the location: in the parking lot, in front of the internal building.

2. In the event of a threat to the life or health of a Participant, the Organizer, security, staff, or medical personnel may take necessary rescue actions, including calling an ambulance or providing medical assistance.

§ 22 – False alarms and triggering fire protection equipment

1. A Participant who intentionally or through gross negligence causes a false alarm, triggers fire protection equipment without justification, or leads to an unjustified intervention of services, bears responsibility for the resulting damage under general rules.

2. The Organizer reserves the right to claim full costs and compensation from such a Participant if the Organizer suffers a loss on this account.

CHAPTER VI — Internal parking and logistics

§ 23 – Parking

1. The Organizer may provide Participants with an internal parking lot on the plant premises.

2. Unless the Organizer clearly indicates otherwise, the parking is free of charge and unguarded.

3. The Organizer is not responsible for the loss, damage, or destruction of vehicles or items left in the vehicles.

§ 24 – Traffic rules

1. Participants moving in vehicles on the plant premises are obliged to obey road signs, security instructions, and speed limits applicable on the plant premises.

2. There is a strict ban on parking on fire roads, evacuation routes, maneuvering areas, and other places not intended for parking on the plant premises.

§ 25 – Vehicle removal and car pickup

1. A vehicle parked in a prohibited place, in particular on a fire or evacuation road, may be removed or towed away at the cost and risk of the owner or possessor of the vehicle.

2. Vehicles should be picked up and removed from the plant premises no later than the day following the day of the Event by 8:00 AM.

3. After the deadline referred to in sec. 2, the Organizer may take order-maintenance actions in accordance with applicable legal regulations and safety rules applicable on the plant premises.

CHAPTER VII — Material liability, property protection, trade secret, and personal data

§ 26 – Participant's liability for damages

1. The Participant bears full material responsibility for damages caused by themselves within the Event Area, in particular to the Organizer's property, equipment, machines, devices, installations, industrial floors, decor elements, and the property of other Participants.

2. In the event of soiling or damaging surfaces requiring specialized cleaning or repair, the Participant may be obliged to repair the full damage, including covering the costs of restoring the previous condition.

3. The Organizer has the right to claim compensation exceeding the amount of any penalties or fees provided for in the Terms and Conditions, if the damage suffered is higher.

§ 27 – Trade secret and prohibition of photography

1. Within the Event Area, there is a ban on photographing, filming, recording, and otherwise fixing:

  • machines, devices, production lines, and installations;
  • control panels, screens, technological markings, and documentation;
  • technological processes, technical solutions, and other information that may constitute a trade secret of the Organizer or its affiliated entities.

2. The prohibition referred to in sec. 1 does not apply exclusively to:

  • places, zones, or moments clearly permitted by the Organizer;
  • materials taken by photographers, camera operators, or other persons acting on behalf of the Organizer.

3. It is forbidden to publish on social media or other public channels content revealing technical details of the plant, precise production layout, technical security measures, or precise geolocation of production, if this could violate the security or interest of the Organizer.

4. On the tour route and in technical zones, the use of mobile phones, cameras, video cameras, voice recorders, smartwatches with an image or sound recording function, and other recording devices is prohibited, unless the Organizer explicitly allows their use.

5. The Organizer may indicate a place, moment, or zone where taking souvenir photos will be allowed.

§ 28 – Commercial and promotional activities of participants

1. Without the Organizer's prior written consent, it is forbidden for Participants to conduct any commercial, marketing, promotional, sales, canvassing, or advertising activities within the Event Area.

2. It is also forbidden to distribute promotional materials, display roll-ups, organize commercial presentations, and acquire contact data for commercial purposes without the Organizer's consent.

§ 29 – Cloakroom and personal belongings

1. If the Organizer provides a cloakroom, Participants should leave their outerwear and other items exclusively in the designated place.

2. The Organizer is not responsible for items left outside the cloakroom or in places not intended for this purpose, unless the damage was caused by the fault of the Organizer or persons for whom the Organizer is responsible.

3. Items not collected from the cloakroom or left on the Event Area will be stored by the Organizer for a period of 30 days from the day of the Event, provided that their properties allow for safe storage. After this period, the Organizer may handle them in accordance with relevant legal regulations or, in the case of perishable, unhygienic, or unstoreable items, dispose of them.

§ 30 – Personal data and image

1. The administrator of the Participants' personal data is HWBAS Sp. z o.o. with its registered office in Warsaw (ul. Wspólna 47/49, 00-680 Warsaw).

2. The Organizer has appointed a Data Protection Officer, who can be contacted at the e-mail address: kontakt@hwbas-groundbreaking.pl, or by mail to the Organizer's registered office address with the note „IOD" (DPO).

3. Detailed information on the processing of Participants' personal data in connection with registration and participation in the Event was provided to Participants at the registration stage in the form of a separate information clause and is also available at the registration / check-in desk during the Event.

4. Participants' personal data may be processed in particular for the purpose of registering participation in the Event, handling the application form, preparing participant lists, sending organizational information, conducting check-in, ensuring the safety of persons and property, organizing entry and access control, organizing the plant tour, documenting the course of the Event, and establishing, pursuing, and defending claims.

5. The Event will be photographically and filmically documented. The Organizer may record the general course of the Event, including wide shots of the hall, event space, and participants, for the purpose of event documentation, internal communication, and preparing event reports.

6. The Participant's image may also be recorded as an element of the entire Event, without exposing a specific person.

7. To the extent that the Organizer anticipates using the Participant's individual image in promotional materials or other materials exposing a specific person, the basis for such action is the Participant's separate consent expressed upon registration via an appropriate checkbox or in another separate form indicated by the Organizer.

8. The scope of the consent referred to in sec. 7, in particular the purposes of using the image, publication channels, and information about the possibility of its withdrawal, results from the content of the consent statement made available to the Participant upon registration.

9. Failure to grant the consent referred to in sec. 7 does not exclude the possibility of participating in the Event.

10. Withdrawal of consent does not affect the lawfulness of the use of the image made before its withdrawal.

11. The detailed scope, purposes, publication channels, and period of using the individual image are determined by the content of the separate consent granted by the Participant.

12. Regardless of the photographic and film documentation of the Event, selected parts of the Organizer's property may be subject to permanent video monitoring conducted to ensure the safety of persons and property and the protection of the plant. The rules for processing personal data within the monitoring are specified in a separate information clause or signs located on the plant premises.

CHAPTER VIII — Final provisions

§ 31 – Force majeure

1. The Organizer is not liable for the cancellation, interruption, delay, or change in the Event program caused by force majeure, infrastructure failure, a decision of public authorities, a security threat, the need for evacuation, or other causes beyond the Organizer's control.

2. Force majeure is considered to be an external, sudden event, impossible to predict and impossible to prevent despite exercising due diligence.

§ 32 – Reporting damages and incidents

1. Any damages, injuries, incidents, or violations of the Terms and Conditions should be reported to the Organizer, security, or staff immediately, if possible during the Event.

2. Failure to report immediately may make it difficult to determine the circumstances of the event and the scope of liability.

§ 33 – Decision-making powers of the Organizer

1. In matters of order, security, and organization of the course of the Event, the decisions of the Organizer, head of security, guide, technical staff, and other persons designated by the Organizer are binding for the Participants.

2. In matters not covered by the Terms and Conditions, generally applicable provisions of Polish law apply.

§ 34 – Legal provisions

1. If any provision of the Terms and Conditions turns out to be invalid or ineffective, this does not affect the validity of the remaining provisions of the Terms and Conditions.

2. The Terms and Conditions are governed by Polish law.

3. To the extent permitted by law, disputes related to participation in the Event will be resolved by a court having jurisdiction under generally applicable legal provisions, provided that in disputes with entrepreneurs, the court competent for the Organizer's registered office may be the competent court.
